Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day
- on which you or a third party named by you, who is not the carrier, took possession of the goods, provided that you ordered one or more goods as part of a single order and these are delivered together;
- on which you or a third party named by you, who is not the carrier, took possession of the last goods, provided that you ordered several goods as part of a single order and these are delivered separately;
- on which you or a third party named by you, who is not the carrier, took possession of the last partial shipment or the last item, provided that you ordered goods that are delivered in several partial shipments or items;
To exercise your right of withdrawal, you must inform us (finkid GmbH, Berliner Straße 46, 10713 Berlin, Telephone no.: +49 30 62937740, Email address: service@finkid.de) by means of a clear declaration (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send the notification of exercising the right of withdrawal before the withdrawal period expires.
Consequences of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments that we have received from you, including delivery costs (with the exception of the additional costs resulting from your choosing a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within 14 days from the day on which we received notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this reimbursement.
We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods without undue delay and in any event no later than within 14 days from the day on which you inform us of the withdrawal from this contract, to us or to Meyer & Meyer Logistikzentrum Peine, C/o finkid GmbH, Lehmkuhlenweg 86, 31224 Peine, Germany. The deadline is met if you send back the goods before the period of 14 days expires.
You bear the direct costs of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to handling them in a way that is not necessary for checking their condition, properties, and functionality.
Exclusion or early expiry grounds
The right of withdrawal does not apply to contracts
- for the supply of goods that are not prefabricated and for the production of which an individual choice or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer;
- for the supply of goods that can spoil quickly or whose expiry date would quickly be exceeded;
- for the supply of alcoholic beverages, the price of which was agreed upon at the time of the conclusion of the contract, but which can be delivered no earlier than 30 days after the conclusion of the contract and whose current value depends on fluctuations in the market over which the trader has no control;
- for the supply of newspapers, periodicals, or magazines, with the exception of subscription contracts.
The right of withdrawal expires prematurely in the case of contracts
- for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery;
- for the supply of goods if, after delivery, they have been inseparably mixed with other goods due to their nature;
- for the supply of sound or video recordings or computer software in a sealed package if the seal has been removed after delivery.
